The Act to improve certainty for flexible workers: what does it actually entail?

Stelt u zich eens voor: u werkt al jaren met dezelfde zelfstandige. Hij stuurt facturen, factureert btw en heeft een eigen kvk-nummer. Toch krijgt u in 2026 ineens vragen van de Belastingdienst over de aard van uw samenwerking. Hoe heeft het zo ver kunnen komen?

The Act to Improve Certainty for Flexible Workers had already gone through the internet consultation round. This act aims to give employees with a temporary contract or an on-call job more certainty about their pay and schedule.

For that reason, it has been decided to tighten the rules, so that on-call workers performing structural work will in principle receive a permanent contract. Flexible work will continue to exist in the future too. Going forward, flex work will really only be permitted to cover “peaks and sickness”.

What will this act specifically bring about?

  • the abolition of zero-hours contracts;
  • on-call contracts only for students and pupils;
  • the introduction of the basic contract

For the basic contract, it is important that the maximum agreed scope of work may not exceed 130% of the minimum agreed scope of work. The minimum agreed work is thereby guaranteed, for example 16 hours per week. The maximum agreed work may then not exceed roughly 21 hours.

To encourage employers to work with a basic contract, the intention is to bring the permanent basic contract under the low unemployment insurance (WW) premium.

The six-month period (interval) will change into an administrative expiry period of five years. This five-year period will in future also apply to temporary agency work in phases A and B. This is intended to put an end to so-called revolving-door constructions.

This new and forthcoming act has NOT been declared controversial, which means that despite the fact that the Netherlands currently has a caretaker government, this bill can in principle simply be dealt with by the House of Representatives.

The parliamentary debate will likely only take place after the elections. We will of course keep you informed of developments regarding this new act and its exact implementation.

De afgelopen jaren stonden in het teken van de Wet VBAR, het wetsvoorstel dat een einde moest maken aan onduidelijkheid over de zzp’er. Het kabinet heeft delen van dat voorstel inmiddels geschrapt. De Belastingdienst handhaaft sinds 1 januari 2025 weer actief op schijnzelfstandigheid. En recente uitspraken van de Hoge Raad bevestigen dat rechters strikt toetsen of er sprake is van ondergeschiktheid en gezagsverhouding.

Voor uw praktijk betekent dit drie dingen. Een: leg de samenwerking duidelijk vast, met aandacht voor de inhoud. Twee: voorkom dat een zzp’er feitelijk werkt als werknemer. Drie: wees voorbereid op een controle, en weet hoe u de relatie kunt herzien als dat moet.
