Illness and dismissal, surely that’s not possible?

Stelt u zich eens voor: u werkt al jaren met dezelfde zelfstandige. Hij stuurt facturen, factureert btw en heeft een eigen kvk-nummer. Toch krijgt u in 2026 ineens vragen van de Belastingdienst over de aard van uw samenwerking. Hoe heeft het zo ver kunnen komen?

No, not in principle, because a prohibition on dismissal applies during illness!

Recently, however, the Utrecht District Court, Subdistrict Section, on 4 April 2024, and the Rotterdam District Court, Subdistrict Section, on 25 April 2024, ruled that the sick employee could nevertheless be dismissed.

Both employees (coincidentally) work at a cleaning company and had called in sick. And despite repeated invitations for meetings and warnings about the possible consequences, both employees avoided contact with the employer.

In Utrecht there was still some contact, but in Rotterdam neither the employer nor the company doctor could get in touch with the employee at all.

Suspending the salary, and even a full stop in pay, also failed to get the employees to respond.

The Utrecht employer then opted for summary dismissal. The Rotterdam employer opted for dissolution of the employment contract.

And both were granted! Why?

In Rotterdam, a prohibition on dismissal did indeed apply because of the illness, but the employee lost this dismissal protection because she refused to cooperate with reintegration and the employer had stopped paying her salary.

In Utrecht, the subdistrict court rightly stated that it is settled case law of the Supreme Court that an employee’s failure to meet obligations relating to illness and reintegration does not, in itself, justify summary dismissal. However, in this specific case, given among other things the fact that there was no response whatsoever and that the employee had been warned about summary dismissal and had been given a final chance, the situation was serious enough to justify summary dismissal after all.

De afgelopen jaren stonden in het teken van de Wet VBAR, het wetsvoorstel dat een einde moest maken aan onduidelijkheid over de zzp’er. Het kabinet heeft delen van dat voorstel inmiddels geschrapt. De Belastingdienst handhaaft sinds 1 januari 2025 weer actief op schijnzelfstandigheid. En recente uitspraken van de Hoge Raad bevestigen dat rechters strikt toetsen of er sprake is van ondergeschiktheid en gezagsverhouding.

Voor uw praktijk betekent dit drie dingen. Een: leg de samenwerking duidelijk vast, met aandacht voor de inhoud. Twee: voorkom dat een zzp’er feitelijk werkt als werknemer. Drie: wees voorbereid op een controle, en weet hoe u de relatie kunt herzien als dat moet.
