{"id":30533,"date":"2020-04-10T14:32:07","date_gmt":"2020-04-10T14:32:07","guid":{"rendered":"https:\/\/thelegalcompany.nl\/?p=30533"},"modified":"2026-09-02T17:36:48","modified_gmt":"2026-09-02T17:36:48","slug":"now-and-continued-wage-payment-how-does-it-actually-work","status":"publish","type":"post","link":"https:\/\/thelegalcompany.nl\/en\/now-and-continued-wage-payment-how-does-it-actually-work\/","title":{"rendered":"NOW and continued wage payment, how does it actually work?"},"content":{"rendered":"\n<p><span style=\"color: #000000;\"><strong>There is currently a great deal of confusion about the award of the subsidy under the Temporary <\/strong><strong>Emergency Bridging Measure for Sustained Employment <span style=\"color: #ff5500;\"><a style=\"color: #ff5500;\" href=\"https:\/\/www.uwv.nl\/werkgevers\/overige-onderwerpen\/now\/index.aspx\">(NOW)<\/a><\/span> and topics such as continued wage payment, flexible workers and dismissal options. In this first blog of a two-part series, we look at continued wage payment for both permanent and flexible employees in relation to the NOW subsidy. In the second blog, we look at dismissal and the NOW subsidy. <\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>100% obligation to continue paying wages?<br \/><\/strong><\/span><span style=\"color: #000000;\">A first point of confusion is the employer&#8217;s obligation to continue paying wages if it claims the NOW subsidy. The letter to Parliament of 17 March 2020 clearly stated as a condition that the employer had to continue paying 100% of employees&#8217; wages, both for employees with a fixed number of hours and for flexible workers.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Only an effort obligation to keep the wage bill level.<br \/><\/strong><\/span><span style=\"color: #000000;\">Yet, in the NOW scheme as published on 31 March 2020, the government no longer imposed a hard obligation of 100% continued wage payment for employers to be eligible for the NOW subsidy. In the final NOW scheme, only an &#8220;effort obligation&#8221; has been included for employers to keep the wage bill as level as possible, in two ways: <\/span><br \/><br \/><span style=\"color: #000000;\">1) by continuing to pay employees&#8217; wages; and<\/span><\/p>\n<p><span style=\"color: #000000;\">2) by preserving employment<\/span><\/p>\n<p><span style=\"color: #000000;\">In this first blog we focus mainly on the continued wage payment obligation and the NOW. In our second NOW blog, we look at the relationship between dismissal and the NOW subsidy; you can find the link to that second blog <span style=\"color: #ff5500;\"><a style=\"color: #ff5500;\" href=\"https:\/\/thelegalcompany.nl\/blog\/2020\/04\/10\/now-en-ontslag-hoe-zit-het-nou\/\">here<\/a><\/span>.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>What does &#8220;continuing to pay employees&#8217; wages&#8221; mean exactly?<br \/><\/strong><\/span><span style=\"color: #000000;\">This is based on the wage bill of January 2020. If the wage bill in March, February and April 2020 turns out to be lower than the wage bill of January 2020 after all, this in principle only affects the amount of the subsidy, and any advances paid too generously may need to be repaid. Unfortunately, no account is taken here of individual situations, for example if employees left after January 2020 and the wage bill is therefore lower as a result.<\/span><\/p>\n<p><span style=\"color: #000000;\">And suppose the wage bill is actually higher in the NOW period compared to the wage bill in January 2020, then no extra subsidy is given! The final compensation can never be higher than 3 times the wage bill of January 2020. If you had a relatively low wage bill in January 2020, then you are out of luck. No correction mechanisms have been built in for this (as yet).<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Contractual continued-wage-payment obligation for permanent employees.<br \/><\/strong><\/span><span style=\"color: #000000;\">Besides the aforementioned effort obligation towards the UWV to keep the wage bill level, there is the wage payment obligation under the employment contract towards the employee. This continued-wage-payment obligation also exists even if there is a downturn in work or revenue as a result of the corona pandemic. How do these two obligations relate to each other? A downturn in work or loss of revenue are and remain business risks that are for the account and risk of the employer, meaning that, in accordance with applicable employment legislation, the employer must continue to pay employees (with a fixed number of hours) with a fixed monthly (or 4-weekly) salary 100% of their wages. The employer is legally and contractually obliged to continue paying the salary for these fixed hours for as long as the employment contract exists, regardless of whether or not there is work available due to the corona crisis.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Agreeing on or unilaterally implementing a wage reduction, and the NOW?<br \/><\/strong><\/span><span style=\"color: #000000;\">In addition, it is the case that, under certain circumstances, an employer could still implement a unilateral wage reduction based on a contractually agreed right to amend, for compelling business reasons (such as the business grinding to a halt due to corona). Always try to reach agreement with the staff concerned first, but if that is not successful, an employer can, under the given circumstances of the case, justifiably make use of this right.<\/span><\/p>\n<p><span style=\"color: #000000;\">Suppose an employer takes this measure now to keep costs manageable for the rest of this year, including during the period for which NOW subsidy is received. Is that possible? The NOW scheme does not, in itself, prohibit this, but given the effort obligation, it is of course better to keep the wage bill as level as possible. If this does not happen, for example because everyone gives something up, this will in any case lead to a lower subsidy being determined and a repayment of part of the advance already received. Even so, reducing wage costs can still be advantageous, with the help of proper calculation and the right timing. Employers can also choose to do this only after the subsidy period, if it turns out that, for example, the decline in revenue also persists after the chosen revenue reference period.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Continued wage payment for flexible workers.<br \/><\/strong><\/span><span style=\"color: #000000;\">For flexible workers, the continued-wage-payment obligation and the NOW effort obligation are somewhat more complicated. Flexible workers normally only have a statutory right to continued wage payment for:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">the fixed minimum hours, if these were agreed in the employment contract;<\/span><\/li>\n<li><span style=\"color: #000000;\">the on-call hours for which a flexible worker had already been scheduled on top of that, where the call-up can no longer be reversed under the (new WAB) statutory or collective agreement rules;<\/span><\/li>\n<li><span style=\"color: #000000;\">the average hours worked over the past 3 months, based on the statutory legal presumption, provided reliance on this has not been validly excluded in the contract during the first 6 months of employment.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">Under a validly agreed zero-hours contract, the employer therefore in principle does not have to pay wages if there is no work, except where the call-up can no longer be reversed. In the case of a min-max contract, in the absence of work, the employee is in principle only entitled to the minimum agreed hours in the contract and the hours he had already been scheduled for on top of that.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>NOW compensation for flexible workers.<br \/><\/strong><\/span><span style=\"color: #000000;\">For these zero-hours and min-max contract workers, the government has now, to preserve employment, arranged that the employer can simply continue paying, in March, April and May 2020, the amount of salary these flexible workers received in January 2020. The employer then also receives the NOW subsidy of up to a maximum of 90% of the wage costs for this. If the employer nevertheless decides not to pay out the January 2020 wage bill to flexible workers, this will lead to a substantial drop in subsidy because of the formula used for this (see calculation example below). When determining the final NOW subsidy, in the event of a decline in the wage bill, the percentage decline in revenue is no longer taken into account. The reduction is then multiplied by the employer costs (set at 1.3) and that in turn is multiplied by 90%. This looks as follows in the example below:<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Calculation example<br \/><\/strong><\/span><span style=\"color: #000000;\">An employer has, in calculating the advance, based on the period January 2020, a wage bill of \u20ac1,000,000 and an expected decline in revenue of 50%. This leads to an expected determination of the subsidy of (0.5 x \u20ac1,000,000 x 3 x 1.3 x 0.9) = \u20ac1,755,000 in total. Of this, the employer receives an advance of \u20ac1,404,000 (namely 80%).<\/span><\/p>\n<p><span style=\"color: #000000;\">The decline in revenue turns out, at the end of the NOW period, to actually be 50%. The final wage bill over the months of March, April and May 2020 is \u20ac2,400,000. The difference in wage bill is therefore \u20ac600,000. This difference is processed in the determination as follows. The first part of the subsidy is determined as expected, \u20ac1,755,000 in total. Since the wage bill has decreased by a total of \u20ac600,000, the amount of the subsidy is reduced. This reduction is ((\u20ac1,000,000 x 3) \u2013 \u20ac2,400,000) x 1.3 x 0.9 = \u20ac702,000. The subsidy is thus determined at \u20ac1,755,000 \u2013 \u20ac702,000 = \u20ac1,053,000, and therefore \u20ac1,404,000 \u2013 \u20ac1,053,000 = \u20ac351,000 is reclaimed from the advance.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Flexible worker&#8217;s claim to continued wage payment based on legal presumption.<br \/><\/strong><\/span><span style=\"color: #000000;\">Regardless of this NOW compensation, flexible workers can, under certain conditions, invoke the legal presumption of the average scope of work (for example, calculated over the months of December 2019, January and February 2020) if, from March 2020, they are suddenly called up less, even if that is due to business closure because of corona, etc. Even so, the UWV, for the subsidy, only takes January 2020&#8217;s salary as its basis. So if the average number of hours over December 2019, January and February 2020 is higher than the number of hours in January 2020, the employer receives no subsidy for the higher number of hours claimed!<\/span><\/p>\n<p><span style=\"color: #000000;\">It is also still something of a question mark, if in March, April and May 2020 you simply continue paying, because of the NOW subsidy, what you paid in January 2020, what a flexible worker can then claim from June 2020 based on this legal presumption. In principle, there has been little or no work performed, but payment has continued. In my view, the legal presumption really concerns a reversed burden of proof regarding the scope of the work. That is based on an average of the hours worked in the three preceding months, and not on an average of the continued wage payment. It does not seem to me that a flexible worker could then keep demanding the payment made in March, April and May 2020 based on this legal presumption, after May 2020.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">Need a NOW and employment law expert?<br \/><\/span><\/strong><span style=\"color: #000000;\">The Legal Company sincerely hopes that, through this sharing of knowledge, you now have a better understanding of how this NOW scheme works and how it impacts labour relations and regular employment law.
