The uncertainty continues.<\/p>\n<p>The latest news is that the Council of State rejected the VBAR bill on 11 November and sent Minister Van Hijum back to the drawing board. The reason for the rejection is that, according to the Council of State, the bill essentially does nothing more than describe the existing practice (applying the current DBA Act along the lines set out in case law, in particular the Deliveroo ruling).<\/p>\n<p>The proposal still fails to give entrepreneurs the much-needed clarity on the correct classification: <em>is this an employee who should receive an employment contract, or a self-employed contractor who can work under a contract for services<\/em>? This is despite the explanatory guidance issued by the Dutch Tax Authorities on 1 November*.<\/p>\n<p>The Minister has already responded to the Council of State&#8217;s rejection. He has indicated that he still intends to proceed with the bill. It now remains to be seen what adjustments he is willing to make. The intended start date of 1 January 2026 now looks certain to be unachievable.<\/p>\n<p>What is certain is that the Dutch Tax Authorities will start enforcing against false self-employment among clients from 1 January 2025.
