This legislation is intended to better protect consumers from unsafe non-food products. What does this mean for your business?<\/p>\n<p><strong>What is changing?<\/strong><\/p>\n<p>Under the GPSR, it becomes even more important to know where your products come from.<\/p>\n<ul>\n<li>You must ensure that the contact details of the manufacturer, importer, or authorized representative (if the manufacturer is established outside the EU) are clearly visible on the product or its packaging.<\/li>\n<li>Every product must also have a unique identification number, such as a type or serial number. This information helps to trace and recall unsafe products more quickly.<\/li>\n<li>A new obligation under the GPSR is that, in the event of a recall, you must offer consumers a full refund or a replacement product. Repairs must be carried out free of charge.<\/li>\n<\/ul>\n<p><strong>Clear instructions for use.<\/strong><br \/>\nConsumers must understand how to use a product safely. This means that all safety information and instructions for use must be clear and accessible. If, for example, you have international customers, make sure the information is available in multiple languages.<\/p>\n<p><strong>Quality system<\/strong><\/p>\n<p>In addition, you are required to use a quality system to monitor the safety of your products throughout the entire production process.<\/p>\n<p><strong>Authorized representative<\/strong><\/p>\n<p>Do you sell products manufactured outside the EU? Then you must appoint a representative within the EU. This authorized representative is responsible for compliance with the GPSR, ensuring that product safety is safeguarded at all times.<\/p>\n<p><strong>Online sales<\/strong><\/p>\n<p>Do you sell through an online marketplace? The GPSR also imposes new requirements on platforms, such as appointing a central point of contact for safety authorities and implementing internal procedures to remove unsafe products quickly.<\/p>\n<p><strong>Prepare for the GPSR<\/strong><\/p>\n<p>The GPSR will be implemented in the Netherlands through an amendment to the Commodities Act (Warenwet) and takes effect on <strong>13 December 2024<\/strong>. The time to adapt your processes and products is short. Make sure you comply with the new requirements and avoid problems when selling your products.
