Privacy is more and more a commercial factor in choosing your company. It is also increasingly part of contractual chain provisions that your customers and main contractors pass on to your company by contract.<\/p>\n<p>Regulators are also paying closer attention, and cyberattacks and hacks are becoming more sophisticated.<\/p>\n<p>Finally, users are demanding more honesty and protection of their personal data.<\/p>\n<p>Anyone who genuinely wants to become privacy-mature in 2026 therefore needs to act now. In this blog we set out the most important recent points of attention from the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, AP).<\/p>\n<ul>\n<li><strong>Stricter rules on cookie banners: no more excuses<\/strong><\/li>\n<\/ul>\n<p>We previously wrote about stricter enforcement of cookie rules, but the topic remains highly relevant at the end of 2025 as well.<a href=\"\/#_ftn1\" name=\"_ftnref1\">[1]<\/a> The AP has recently officially warned more than 200 Dutch websites because of misleading cookie banners. As a result, three-quarters of these sites have made improvements, such as a clear option to refuse. For websites that refuse to make changes, a formal investigation has since been opened.<\/p>\n<p>The AP&#8217;s message is clear. The consent of website users must be free, informed, and just as easy to refuse as to give. To help organisations, the AP even launched a public awareness campaign on 2 December 2025 called &#8220;<em>Ga slim om met cookies<\/em>&#8221; (&#8220;Be smart about cookies&#8221;). In this context, the AP also advises organisations to draw up a proper cookie policy in addition to setting up a clear and correct cookie banner.<\/p>\n<p>Transparency about tracking and consent is regarded as a basic right of users, and in 2026 this will rank even higher on the AP&#8217;s agenda. So be aware of this, not least to avoid fines.<\/p>\n<ul>\n<li><strong>Cyberattacks: the processor agreement to the rescue<\/strong><\/li>\n<\/ul>\n<p>Besides misleading cookie banners, the AP also warns of the risks when personal data is processed by external parties, such as IT service providers or hosting providers. When agreements on privacy responsibilities are missing, organisations get completely stuck during a cyberattack. There is then insufficient information to assess what has been leaked, with the result that data subjects and victims are not informed of their vulnerable position.<\/p>\n<p>The AP recently carried out a thematic investigation into the role of the processor agreement in cyberattacks on service providers. This produced three concrete recommendations:<\/p>\n<ol>\n<li><strong>Make processing arrangements as concrete as possible<\/strong><\/li>\n<\/ol>\n<p>Arrangements in the processor agreement must be clear and specific about what happens to personal data and how the parties comply with the GDPR. This means the agreement must include, among other things:<\/p>\n<ul>\n<li>a clear division of roles (who is the controller, who is the processor)<\/li>\n<li>an exact description of the purpose, duration, nature, type of personal data and the groups of data subjects involved<\/li>\n<li>application of data minimisation and a concrete retention period<\/li>\n<li>reachable contacts for reporting data breaches<\/li>\n<li>an agreed reporting deadline and minimum content of notifications<\/li>\n<\/ul>\n<p>Without these documented arrangements, a cyberattack causes too much delay and confusion, with the result that victims are informed too late or not at all.<\/p>\n<ol start=\"2\">\n<li><strong>Keep a grip on the entire supply chain<\/strong><\/li>\n<\/ol>\n<p>Even when several service providers are involved (&#8220;sub-processors&#8221;), the controller remains fully responsible for the protection of personal data. The controller must therefore ensure it has insight into:<\/p>\n<ul>\n<li>an overview of the entire chain: who processes what and why?<\/li>\n<li>insight into the security measures at every link in the chain;<\/li>\n<li>up-to-date information about sub-processors, including location and security;<\/li>\n<li>good cooperation with the processor and coordinated incident procedures.<\/li>\n<\/ul>\n<p>In the event of a cyberattack, organisations can only act quickly and adequately if all data flows and parties have been mapped out.<\/p>\n<ol start=\"3\">\n<li><strong>Prioritise drawing up and maintaining processor agreements<\/strong><\/li>\n<\/ol>\n<p>Processor agreements are still too often treated as a side issue: they are only discussed after the main contract has been signed, are not updated, or are not documented specifically enough. This leads to (security) incidents. It is therefore important that privacy-mature entrepreneurs:<\/p>\n<ul>\n<li>negotiate in good time and critically, with a focus on security and the duty to report data breaches;<\/li>\n<li>regularly review the arrangements and put them into practice, so that the processor agreement effectively becomes a dynamic and evolving agreement;<\/li>\n<li>provide employees with sufficient guidance and privacy knowledge;<\/li>\n<\/ul>\n<p>Only a current and living agreement genuinely helps in a cyberattack and is legally enforceable when it matters.<\/p>\n<h5><strong>The common thread running through these developments?<\/strong><\/h5>\n<p>Whether it concerns honest and clear cookie banners or concrete arrangements with service providers in the chain: in both cases everything comes down to strengthening the trust of users and customers. It is clear that it is no longer enough to simply tick the box &#8220;processor agreement in place&#8221;. If you depend on suppliers, that requires correct and up-to-date arrangements, including clear reporting deadlines for data breaches and cybersecurity obligations.<\/p>\n<p>Privacy is not a one-off obligation or a checklist to tick off. It is a continuous process of improving, updating, and staying alert to risks.
