At The Legal Company, we of course also use artificial intelligence as a tool to take our work for you as an SME client to a higher level \u2013 but not to replace ourselves as lawyers. In this first contribution to our new Legal Alert column, we’re happy to explain exactly how we do that.<\/p>\n

TLC uses public LLMs smartly but very sparingly.<\/strong><\/h4>\n

Everyone uses Large Language Models (LLMs) such as ChatGPT or Perplexity to analyse huge amounts of information and explore draft texts, analyses and scenarios more quickly. But these are, and remain, predictive language models that work on the basis of probability and the prediction of the most logical and commonly used next word. Not necessarily the correct word. These LLMs are trained on very broad datasets whose origin, currency and reliability are not always transparent.<\/p>\n

Legally, we obviously cannot build on and trust that. That is not what you pay us for. The daily use of AI in our legal work demands care. We always critically test AI output against the law, case law and our own professional standards. We check sources, verify factual assumptions and adapt texts to the client’s specific situation. We never adopt AI answers one-to-one: their use is a starting point, not a finished product. This way we prevent inaccuracies, outdated information or ‘hallucinations’ from an AI model from finding their way into legal advice, a contract or a procedural document.<\/p>\n

That is why we do not use ChatGPT, Claude, Perplexity or any other public LLM model for our case work and case-law research, drafting contract mark-ups, drafting advisory notes or emails, etc.<\/p>\n

We do use these models to get support with matters not related to clients, or where we carry out fact-finding or background research without disclosing any case or client data. In that case we use Perplexity, because in terms of sources it is the most up to date.<\/p>\n

TLC invests in the right legal AI tooling.<\/strong><\/h4>\n

For our case work, we have invested significantly in specialised AI tooling. We used two AI tools side by side for a year, tested them, and kept the best one.<\/p>\n

For legal research such as literature, case-law and legislative research, we use a paid business licence for a legal sources and AI platform from legal publisher SDU. The truly valuable legal information from the literature, specialised journal articles, certain court rulings and the commentary and explanation on them, sits behind paywalls.<\/p>\n

These are better manageable data sources (such as legal databases and our own document environments). The LLMs cannot access them, because they only analyse information available on the internet.<\/p>\n

We have also invested in an AI tool that lets us legally analyse, improve and adapt Word documents, contracts, etc. Even when using this tool, the right questions still need to be asked, and the generated text suggestions still need to be checked word for word. We can indeed work faster, but it remains human work, and therefore still time-bound work. The advantage of AI support is that the basic tasks can be done faster, so more time can be spent on delivering bespoke work, fine-tuning and the human element.<\/p>\n

We also use a professional, paid AI translation tool for translations, with privacy safeguarded.<\/p>\n

Investment in AI training<\/strong><\/h4>\n


\n<\/strong>We also invest time and money in implementation and internal and external training, to be able to use these systems as well and optimally as possible. So-called legal prompting is a discipline in its own right. Prompting refers to the way we instruct AI. Good legal prompting is specialist work, and all lawyers, young and old, need to master that specialism well. It requires not just a feel for language, but above all in-depth knowledge of the relevant areas of law, insight into procedural risks and understanding of the client’s context. Without that legal background there is a risk that an AI system gives a verbally convincing but legally incorrect or incomplete answer. Within The Legal Company we therefore keep a close eye internally on correct prompting and AI tool use, and we invest in our own ‘prompt recipes’.<\/p>\n

Our work isn’t getting cheaper, but the price-quality ratio is improving.<\/strong><\/h4>\n

In general, our work will not become cheaper.
\nFirstly, because working with the right AI tooling also requires substantial investment. These are not cheap licences. As mentioned, on the principles of reliability and confidentiality we obviously cannot and may not use public LLMs for our case files.<\/p>\n

Secondly, because the time saved can now be used to deliver a higher quality of legal work. Where we can now generate good (model) texts and basic answers more quickly, even more time can be spent tailoring the text, the advice or a contract to the specific situation. A contract or piece of advice has more effect and value when it is tailored to the specific situation. That is precisely the pick of the litter, and it is now becoming far more accessible for SMEs!<\/p>\n

Where previously only expensive firms with highly specialised teams could deliver that quality to large clients with deep pockets (because they could afford the intensive time investment), this has now become more attainable for SMEs.<\/p>\n

Privacy is key<\/strong><\/h4>\n

Another reason why we use paid AI tools and not LLMs for our case files is, of course, privacy. Public, generic LLM AI systems are often powerful and user-friendly, but it is not always clear what happens to the data entered and where it is stored. That makes such tools less suitable for processing confidential documents or privacy-sensitive information belonging to our clients.<\/p>\n

In summary:<\/strong> AI offers enormous opportunities to make our legal services faster and therefore of higher quality, more complete and more insightful, but at the same time it demands careful choices, substantial investment and robust safeguards. With every use of AI, one question is central for us: does this benefit the client, both in substance and in terms of risk? As long as the answer to that is ‘yes’, and we meet our legal and ethical obligations, we will gladly invest in and work with the best AI tools as a valuable reinforcement of our work and your business.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"
